Michelle Raub

The first case, Whitaker v. Raub, concerned an unpaid loan used to cover rent. Michael Whitaker Jr. sued his former friend, Michelle Raub, after paying money directly toward her housing costs.

The central question was not whether Whitaker had paid the rent. Raub acknowledged that he had. The dispute was whether the payment was a loan that she was required to repay—or a gift made to help her through a difficult period.

A Single Mother, Unstable Income, and Back Rent

Raub told the court she was 40 and living with her two children, ages 12 and 14. She had lived in the same apartment for approximately a year by June. Her income came from part-time bartending and a full-time position as a loan officer at Global Equity Finance, which she said she began at the start of May 2018.

Her financial situation had been unstable. She testified that she had been let go from four positions during 2017, including jobs at two mortgage companies that closed their San Diego branches. She also referred to a restaurant management position and an earlier role as a public relations director for a design-build firm, where she had worked for six months.

The court also heard that Raub was not receiving child-support payments despite an order being in place. She said the order did not put food on the table. She acknowledged falling behind on rent four times, with the arrears accumulating to approximately three months. She had not received an eviction notice and said the rent had been made up through payments, with help from a friend who was her property manager.

Against that backdrop, Raub met Whitaker through a social-media livestream. He was one of her followers. They met in person around March or April 2018, when she said she was approximately three months behind on rent. Their first in-person meeting took place at the bar where she worked part-time.

Raub described the relationship as friendly and denied that they had been intimate. She said they had conversations about finances and her circumstances as a single mother, but she could not remember exactly whether the discussion about rent occurred in person, by phone, or through text messages.

The Texts and the Dispute Over Intent

Whitaker gave a different account of the frequency and nature of their contact. He said they had spoken by phone only about twice and had met a couple of times. He also presented messages that, in his view, showed Raub understood the money was expected to be repaid.

One text discussed in court was sent on June 18. The specific text shown during the exchange did not, according to the judge, mention rent. Whitaker said he had other messages describing Raub’s financial hardship and messages in which she thanked him for paying the rent and said the situation was making her feel sick.

The testimony also focused on a message in which Raub suggested she was willing to do whatever was necessary to earn money, including becoming an escort to married men. Raub connected the issue to memories of control and said that when money becomes part of a relationship, it can become a source of power. She referred to experiences with her first ex-husband and said she felt Whitaker’s payment had created a similar dynamic.

Judge Judith Scheindlin challenged that explanation. The court noted that Raub had met Whitaker only recently, had described the relationship as non-intimate, had told him about her financial situation, and then received money. Raub’s messages also included statements that she would pay him back. When asked why she had made those promises, she characterized them as an attempt to placate him and get him off her back.

The judge challenged that framing. In the court’s questioning, Whitaker had not simply been demanding money without context; he was asking about a payment he believed was owed. He testified that he paid $4,900, plus processing fees, and produced bank records. The records included two payments on June 18—one for $3,000 and another for $1,900—to A&S Realty.

The evidence also raised questions about access to Raub’s account. She acknowledged that she had given Whitaker the account information so he could deposit money for the rent. When she complained that he was still accessing the account, Whitaker answered that she had given him the password. The judge emphasized that the arrangement was part of the financial transaction the court had to evaluate.

The $4,900 Judgment

Judge Scheindlin ruled for Whitaker in the amount of $4,900. The case ended with Raub ordered to repay the amount claimed by Whitaker.

Afterward, Whitaker said he believed the judge had seen what was really happening in the paperwork. He described himself as a generous man who had tried to help a friend in a difficult situation. He also said Raub had been dealing with multiple layoffs and a divorce, and that people should look out for friends when they have the means to help.

The ruling did not erase the hardship Raub described. It did, however, distinguish sympathy from a legal obligation. The testimony presented a person under financial pressure, but the court focused on the evidence surrounding the payment, the account access, and the repeated statements that the money would be repaid.

Case Two: Erin Knutson v. Amy Schwager

The second case, Knutson v. Schwager, moved from rent debt to online romance. Erin Knutson sued her former friend, Amy Schwager, for a loan Schwager used while trying to send money to a man she believed was connected to the military and unable to return home from Afghanistan.

The case turned on a question that became increasingly difficult to avoid: what responsibility does a borrower have when the money was sent into an online relationship built on claims that the judge sharply questioned?

A Relationship That Existed Online

Schwager testified that she met the man on Plenty of Fish and had known him for more than two years. She said he lived in Minneapolis, Minnesota, while she lived in Butterfield, Minnesota. Although they had video chatted, she had never met him personally.

She told the court that the man had traveled overseas to Afghanistan and Nigeria for military service. When Judge Scheindlin pressed her, Schwager said she believed he was in the military.

Schwager had known Knutson for approximately five or six years. The two women were connected through Butterfield and LaSalle, Minnesota, and through bartending. Their friendship was longstanding compared with Schwager’s online relationship, but Schwager’s request for money placed that friendship in the middle of a relationship Knutson had never personally verified.

The Afghanistan Story and the $750 Loan

Schwager asked Knutson for $750. She acknowledged receiving it and sending it to the online contact, whom the testimony later identified as Charles. Schwager also said she sent approximately $2,000 of her own money, with the remaining amount sent about four months after the first transfer.

Her explanation was that Charles had been discharged from the military and told her he would not be helped home. Schwager said he needed money to return. The judge questioned how a military service member could be discharged and left in Afghanistan, pointing out that the military would ordinarily bring someone home rather than simply leave him thousands of miles away.

Schwager accepted that this was what Charles had told her—and that she believed him. When asked why, she referred to the video chat. The court’s response was direct: the video chat did not establish the truth of the story. Schwager believed it because she wanted to believe it.

The judge compared the story with familiar scam patterns: a person allegedly kidnapped or held for ransom, a request to wire money to secure release, or a supposed inheritance that requires an upfront payment before the larger sum can be delivered. These were presented as warning patterns, not as a separate finding that Charles had been proven to be a scammer.

Schwager said Knutson knew the money would be sent to Charles and believed there would be additional money in return. According to Schwager, Charles had said he would repay Knutson double. But the court focused on the fact that Schwager had asked Knutson for the money and that the promised repayment had not occurred.

The Court’s Decision

Judge Scheindlin ruled that Schwager had to return the $750 to Knutson. The judgment was for the plaintiff.

The decision addressed the financial agreement between the two friends, not whether every detail of Charles’s identity or military history could be independently established from the testimony. The practical result was clear: Schwager had borrowed the money, sent it to a person she had never met, and remained responsible for returning what she had taken from Knutson.

What These Two Cases Reveal

Together, the cases show two different forms of financial vulnerability.

In the first, a woman facing unstable work, unpaid child support, and mounting rent accepted help from a man she had met through social media. The dispute became a question of whether compassion had been offered as a gift or as a loan.

In the second, a woman trusted an online relationship and borrowed money from a longtime friend to respond to an urgent story about a man overseas. The dispute became a question of whether belief in that story changed her responsibility to repay the lender.

Neither case requires the audience to dismiss the hardship described by the defendants. But the court treated hardship and obligation as separate issues. A difficult situation may explain why someone accepted money. It does not, by itself, determine whether the money must be repaid.

The testimony also underscores a recurring warning in financial disputes: emotional closeness, online contact, and urgent promises can make documentation even more important. In both cases, texts, account records, payment histories, and the parties’ own statements became central to the ruling.

FAQ

Who sued Michelle Raub in the first case?

Michael Whitaker Jr. sued Michelle Raub over money he said he paid toward her rent as a loan. Judge Judith Scheindlin ruled for Whitaker in the amount of $4,900.

How much rent money did Michael Whitaker Jr. pay?

Whitaker testified that he paid $4,900, plus processing fees. The payment records discussed in court showed two payments to A&S Realty on June 18: $3,000 and $1,900.

Did Michelle Raub say the relationship was intimate?

No. Raub denied having an intimate relationship with Whitaker and described their connection as friendly.

Who was sued in the second case?

Erin Knutson sued her former friend, Amy Schwager, for $750. Schwager had borrowed the money and sent it to a man she met online and believed was connected to the military.

Why did Amy Schwager send money to Afghanistan?

Schwager testified that the man, later referred to as Charles, said he had been discharged from the military and could not get home from Afghanistan. She believed his account after communicating with him online and through video chat.

What was the judgment in Erin Knutson’s case?

Judge Scheindlin ordered Schwager to return $750 to Knutson and entered judgment for the plaintiff.

One woman needed help with her rent.
